Hollywood has often been criticized for its lack of diversity in hiring and storytelling. UNIFY has been created to address those critiques. We strive to assemble an diverse inventory of DVDs for users to purchase at the lowest price to promote culture and community. Why? Three simple reasons.

1) OUR PAST DESERVES IT.
The rich history of movies and television shows show the evolution of society and the incredible contributions of mankind. We must never forget the great stories of the past, because they deserve to be celebrated.

UNIFY's filtering software is not about censorship. Our software allows you to freedom to experience great programs in your home based on how you govern your home. UNIFYme.tv is a project managed by UNIFYME Enterprises, LLC ("UNIFY") and UNIFY Digital Library for Black Arts and Culture, Inc ("UDLBAC"). UDLBAC is a non-profit archive and educational think tank that leads socially conscious research and develops tools needed for educators, psychologists, mental health professional and institutions of higher education to develop practical interventions designed to produce equity in society. Our mission is to make artistic and cultural works accessible to the public for social change.

MEMBERSHIP AGREEMENT

Members who sign up for UNIFY become Club Members who have the privilege of purchasing DVD's at a reduced price. Once DVD's are purchased members can elect to view their DVD in the privacy of their own home via UNIFY's Streaming Software. A Monthly membership is a great way to start saving big on buying DVDs from classic and recent releases. Read below for the details.

A GREAT DEAL

Choose a DVD and purchase it for $20 using your UNIFY Credits. The retail price for most of our DVDs is between $20.00 and $35.99 but we charge UNIFY Members $20 per DVD. After purchasing the DVD we let members watch their DVD online and set filters to mute content they personally may find offensive. If you want to keep the DVD you may pay keep it in our vault or pay an additional price plus shipping, processing, and applicable taxes. As part of your membership we agree to let you sell-back any DVD you purchase immediately after viewing on UNIFY whether or not you enjoyed the content. We will buy your DVD back less 1¢ of your purchase price. The 1¢ comes out of your UNIFY Credits that you received with your $5.99 club membership. We do not have a minimum purchase for your monthly membership so you are never pressured to buy! To get started, simply sign-up for a monthly membership plan and pick your first DVD. Watch the DVD you purchased online as a courtesy. Heck you bought it, and you should be able to watch it right away. After viewing your purchase you have 24 hours to let us know if you want to keep the DVD. If you don't email we assume you want to cancel your order. But, If you don't want to buy it, don't ask for your 1¢ returned. We keep your 1¢ as a convenience fee to insure we can maintain update of filtering software, build our inventory and preserve this rich archive of digital Black history. The UNIFY Club has a huge selection of DVD's and box sets usually priced at $19.99 and higher, excluding shipping so we want you to be sure that it's a keeper. (NOTE: Specially priced DVDs or Pay Per View exclusive content is occasionally placed in the UNIFY catalog. This content is outside of your Club Membership Agreement, and would require a special purchase price.)

New DVDs are added to our marketplace and posted on our website about every 3 weeks (up to 22 times a year) plus other special promotions. The online catalog highlights the UNIFY Club Member Favorites and Celebrity Selections from some of your favorite Hollywood stars. Yeah, UNIFY has friends in Tinseltown and you'll love to watch some of their favorites. The biggest title of the month may be picked by you or one of your Hollywood crushes. If you don't want a movie or TV show that you've viewed, do nothing and your order will be cancelled. If you want to keep the DVD send us an email at (order@UNIFYme.tv) and we'll send you a final invoice to process your order.

You’ll always have 24 hours to decide if you want us to ship you the DVD. If you delay or your shipping request after viewing your DVD could get sold to someone else. In that instance the DVD you ordered is backlogged or delayed. Just give us a few weeks to restock and we will ship you order. A shipping and processing charge (and sales tax, if applicable) is added to each order. Shipping and processing charges cover all associated costs and services, including labor, materials, packing and postage. Heavy and/or bulky items may have additional charges. Express shipping is extra. Shipping and processing rates are subject to change without notice. We will send you delivery rates before shipping your DVD so you will have a chance to accept the final costs.

PAYMENT OPTIONS

The credit/debit card you provide will be used for your $5.99 Club Membership Fee and for all future shipments and Club charges. You must keep a credit/debit card on file during your membership and you must keep us up-to-date with accurate member information, including your name, address, credit or debit card number and expiration date.

Once you become a member, if you wish to change your credit/debit card, just contact Customer Service or visit the “Account” section of our website. You can also change or edit your payment method when placing an order or making a payment with your credit/debit card. We will continue to apply your payments under this payment method unless you notify us through Customer Service to change your billing preference. We accept payment by credit/debit card (i.e. American Express, VISA, Discover and MasterCard). Orders using a bank card will be processed as soon as bank authorization is received.

A valid credit/debit card must be kept on file for all future shipments and Club charges. Once you are a member, you can use pre-paid/gift cards for one-time purchases.

If you have selected a credit or debit card as your payment method and the charge cannot be processed on that card (for example, the card has expired or we cannot obtain authorization from your card issuer), then for your convenience, we will attempt to charge any other credit or debit card that you have placed on file with us, in order to prevent disruption of your membership. When you update your payment method, any pending orders or charges will be applied to the new payment method you provided. We are not responsible for any fees or charges that your bank, credit card or debit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method through a mailed statement.

FULFILLING YOUR MEMBERSHIP COMMITMENT

If your account becomes overdue we will send you a reminder. All selections purchased through your UNIFY Club Membership are intended for personal use only and not for resale or any other commercial purpose. Watching your DVD title through our streaming service is for your home viewing only. We reserve the right to cancel the account of any member suspected of violating this requirement and may limit the number of copies/titles that may be ordered on any account.

By joining the UNIFY Movie Club you are not obligated to keep any DVD. You can sell back any and every title immediately after viewing.

There are no minimum monthly DVDs that you have to purchase.

You agree that the maximum physical DVDs that can be delivered to your home is 2 DVDs in any thirty-day period. All DVDs ordered for home delivery require paying the remaining balance owed (minus the 1¢ down payment) plus shipping and handling per each DVD.

HASSLE-FREE RETURNS

To ensure that your account is properly credited, you must return any unwanted items within 24 hours of viewing. We have setup each account to sell back a DVD immediately after viewing for your convenience. If you want to keep it you will have to send us an email (order@UNIFYme.tv). There is no minimum monthly purchase requirement, however orders of more than 3 DVDs in any given month may be delayed up to 60 days. We reserve the right to refuse all DVD returns. If you have opened or removed the outer wrap or other seals from the enclosed selection, no refunds, adjustments or credits will be made unless the selection is defective or damaged.

All claims for non-receipt of shipments must be made within 150 days from date of order. Replacement of and credits to your account for shipped merchandise claimed as not received may be subject to our investigation, which may include postal service notification. We will adjust your account at our discretion. Repeated claims of undelivered merchandise may result in our canceling your membership and billing you for any remaining purchase commitments you may have.

RESEARCH PREFERENCES

From time to time, we may send you a questionnaire about our services for educational research purposes. Your participation is desired but not required to be a UNIFY Club Member. We may offer special promotions for participants who choose to respond to our research study, however If you don’t want to participate in a survey just ignore it.

NOTICE OF ARBITRATION AGREEMENT

UNIFY DIGITAL LIBRARY FOR BLACK ARTS & CULTURE, Inc. and you agree to ARBITRATE all disputes and claims between us arising out of or relating to this Agreement, as broadly interpreted to include any aspect of our relationship, including claims related to advertising. You thus GIVE UP YOUR RIGHT TO GO TO COURT, EXCEPT that YOU MAY bring an action against us in SMALL CLAIMS COURT. The arbitration will be under the prevailing Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association (the “AAA Rules”), as modified by this Agreement. The AAA Rules, including how to initiate a claim, are available online atwww.adr.org or by calling the AAA at 800-778-7879. If you choose arbitration, your rights will be determined by a neutral arbitrator and NOT a judge or jury. You are entitled to a FAIR HEARING, BUT arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.

Arbitrations will be conducted by one Arbitrator and will be Desk Arbitrations unless you or we request a Telephonic Hearing (as defined by AAA Rules). There will be no In-Person Hearing unless a claim seeks more than $75,000. We will pay all filing, administration, and arbitrator fees, unless the Arbitrator finds that your claim had no reasonable foundation or was brought for an improper purpose, in which case the Arbitrator must order you to pay those costs. After you notify us that you have commenced arbitration, we will promptly reimburse you the filing fee. If the Arbitrator issues an award in your favor on the merits of your claim that is greater than the value of our last written settlement offer made before the Arbitrator was selected, then the Arbitrator also may award you your reasonable attorney’s fees. We will not seek attorney’s fees from you even if we prevail. The Arbitrator will be bound by this Agreement.

The Arbitrator may award declaratory or injunctive relief only in favor of the party seeking relief and only as necessary to provide relief warranted by that party's individual claim. YOU AND DIRECT BRANDS, INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and UNIFY DIGITAL LIBRARY FOR BLACK ARTS & CULTURE, Inc. agree otherwise, the Arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

CHANGES TO MEMBERSHIP

We're always looking at ways to improve your membership experience. Accordingly, please note that Club services, promotions, policies, benefits, charges, programs, terms and conditions of membership are subject to change at any time. We will always notify you well in advance of any changes. By enrolling and continuing your membership, you accept and agree to the terms of this Membership Agreement and any changes made by us to it once we notify you of these changes. If you're not satisfied with the terms of the Membership Agreement or with the changes, you may cancel your membership without further obligation.

We reserve the right to request additional information, reject any application or cancel any membership.
